Apple fails to ban Samsung phone, tablet sales in the US… for now

Samsung Galaxy Tab 10.1

Apple may have managed to win a preliminary injunction that bans Samsung from selling smartphones and tablets in Germany, but a federal judge in California has denied a request for a similar ban in the US.

In other words, Samsung can continue selling its Galaxy line of smartphones and the Samsung Galaxy Tab 10.1 while the court case proceeds. There’s still a chance that Apple could win the case at trial, which could lead to the devices being pulled from the market, but we haven’t reached that phase of the legal proceedings yet.

Apple has been going after Samsung in courts around the world, claiming that the company’s Android phones and tablets infringe on Apple’s design rights and patents for the iPhone and iPad. Samsung has also filed some suits of its own against Apple. So far none of the cases has reached a final ruling.

While we’ve been hearing about these lawsuits for months, most of the news that’s come out so far has involved requests for preliminary injunctions — which would be temporary bans on sales of devices while the case proceeds.
